ECJ blocks American ‘La Mer’ trademark bid

The European Court of Justice’s (ECJ) Court of First Instance has dismissed a bid by American cosmetics company La Mer Technology Inc of New York to secure EU trademark rights to its mark ‘La Mer’ for cosmetics, soaps, perfumes and other personal care products.


The European Court of Justice’s (ECJ) Court of First Instance has dismissed a bid by American cosmetics company La Mer Technology Inc of New York to secure EU trademark rights to its mark ‘La Mer’ for cosmetics, soaps, perfumes and other personal care products.

The court backed Laboratoires Goëmar of Saint-Malo, France, which successfully claimed there was a risk of confusion with its previously registered ‘Laboratoire de la Mer’ mark, which covers cosmetics and perfumes.
